1. About PetTally

PetTally is a pet health record app that helps owners log, organise, and share their pet's health history, including vet visits, medications, vaccines, weight, and documents. PetTally is operated by Albert Kyei-Mensah, based in the United States ("we", "us", "our"). Contact: [email protected].

2. Eligibility

You must be at least 13 years old to use PetTally. By using the app, you confirm that you meet this age requirement. If you are under 18, you must have parental or guardian consent.

3. Your Account

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when creating your account.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you believe your account has been compromised.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use PetTally for any unlawful purpose or in violation of any applicable laws
• Upload content that is fraudulent, misleading, or violates third-party rights
• Attempt to reverse-engineer, decompile, or tamper with the app or its infrastructure
• Use automated scripts or bots to access the service
• Attempt to gain unauthorised access to other users' data
• Upload files containing malware, viruses, or harmful code
• Use the service in a way that could damage, disable, or impair its availability

5. Not a Substitute for Veterinary Advice

All health information in PetTally is entered by you, the owner. We do not verify or validate any health records. AI-generated insights are informational summaries based on your logged data and are not veterinary diagnoses or medical advice.

Always consult a licensed veterinarian for medical concerns about your pet. Do not delay seeking veterinary attention based on anything shown in PetTally.

6. Subscriptions and Payments

PetTally offers a free tier and a Premium subscription. Premium features are available via monthly, annual, or lifetime purchase.

• Billing: Subscriptions are billed through the Apple App Store or Google Play Store. Payment is charged to your store account at confirmation of purchase.
• Auto-renewal: Monthly and annual subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: Manage or cancel your subscription through your App Store or Google Play account settings. Cancelling stops future renewals; access continues until the end of the paid period.
• Refunds: Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.
• Lifetime purchase: A one-time payment granting Premium access indefinitely for the purchased platform.

7. Your Content

You retain ownership of all content you upload to PetTally — pet profiles, health records, documents, and photos. By uploading content, you grant us a limited, non-exclusive licence to store and process it solely for the purpose of providing the service to you.

You are responsible for ensuring you have the right to upload any content you add to the app. We do not claim ownership of your data.

8. Pet Passport and Sharing Features

When you generate a Pet Passport QR code or invite a caregiver through Family Access, you are choosing to share specific information with third parties (vets, caregivers). You are responsible for managing these sharing permissions. We are not responsible for how third parties use information you choose to share with them through these features.

9. Insurance Records Disclaimer

PetTally can generate an Insurance Claim Pack from your logged health records. This document is based entirely on owner-entered data and is clearly marked as such. PetTally makes no guarantee that any insurance claim will be accepted or that the records will be sufficient for any particular insurer's requirements. Always verify requirements directly with your insurance provider.

10. Data and Account Deletion

You may delete your account at any time from within the app (Settings → Delete Account). Upon deletion, all your data — including pet profiles, health records, uploaded documents, and files — is permanently and irreversibly deleted from our servers. This action cannot be undone.

11. Service Availability

We aim to keep PetTally available at all times, but we cannot guarantee uninterrupted access. The service may be unavailable during maintenance, updates, or due to circumstances outside our control. We are not liable for any loss resulting from downtime or service interruptions.

12. Intellectual Property

The PetTally app, its design, branding, and all original content (excluding your user data) are owned by us and protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of PetTally without our written permission.

13. Disclaimer of Warranties

PetTally is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free, secure, or continuously available.

14. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use PetTally, including but not limited to loss of data, loss of revenue, or harm to your pet resulting from reliance on information in the app.

Our total liability to you for any claim arising from these Terms or your use of PetTally shall not exceed the amount you paid us in the twelve months preceding the claim (or $10 USD if you have not paid us anything).

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notice or email. The updated date at the top of this page will reflect the most recent revision. Continued use of PetTally after changes take effect constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the United States, unless applicable consumer protection laws in your country require otherwise.
